you can't blame the obama administration for that. the other thing is i think the decision to prosecute this guy in boston is exactly right. the witnesses are there, the police who apprehended them are there. some people want to send them to gitmo, for goodness sakes. it is ridiculous. the enemy combatant thing, maybe i am wrong, but let's assume they fought that issue on a legal standpoint and it wasn't an enemy combatant. this is a clear cut case. let them prosecute the guy. he will get the death penalty or close and i don't know what that is. >> purgatory. >> yes, purgatory. i think this is the right decision to be made and everybody has done good job with the exception of the fbi. >> should the fbi be allowed to now go into mosques and wiretap and sur veil? >> no. >> why not? see i think this is is a great case for opening up that -- >> because if you have a sk month where there is -- mosque where there is significant suspicion, yes. >> how about in boston where the aman and that mosque which is about as strong a connection as you

i strongly disagree with the obama administration's decision to roll out and in the combat the status for the suspect at this time. i believe such a decision is premature. it is impossible for us to gather the evidence in just a few days to determine whether or not this individual should be held for questioning under the law of war. the decision by the administration to try this individual in federal court is a sound decision. it is the right decision. military commission trials are not available in cases like this. i wrote the 2009 military commission act. i have been the judge advocate for over 30 years, along with the help of many colleagues. we created a system for foreign terrorists. we purposely excluded american citizens. i have all the confidence in the world in article 3 courts at the federal level. they do a terrific job. i have confidence in our military commissions system. the decision by the administration not to proceed in state court in massachusetts i think was the correct decision. the death penalty will be available at the federal level. this is clearly in my view a

a policy decision the obama administration has made. he was a american citizen and naturalized last september and now a federal law, the national defense authorization act of 2012 that says american citizens cannot be tried in military commission. so it's not -- this debate is not a question about where he should be tried. the republicans who say he should be treated differently, their claim is that while they understand the civilian trial will go forward, they think he should be treated for now as an enemy combatant and questioned without any question about his rights, without any issue about whether information he gives would be used in his trial, and then turn back over to civilian authorities. but, clearly, the justice department will have none of that. that's not how it's going to go. >> he's in a boston hospital under heavy guard and serious condition including a gunshot wound to the throat but he is responding to some questions to a team the federal investigators in writing. any indication as to what he is saying or maybe perhaps
